1. Introduction

1.1 These Terms and Conditions (the Terms) apply to www.healthservicekicks.com (the Website). The Terms set out your obligations and those of Cash Kicks Ltd (“Cash Kicks”, “Health Service Kicks”, “We” or “Us”). By using our website and/or by registering as a member, you accept the Terms. If you do not agree with the Terms, please cease the use of our website immediately.

1.2 “User” or “Users” refers to you and any visitor or user of the Website.

1.3 “Organisations” refers to the charities or workplaces that will receive donations generated by our members.

1.4 “Retailers” refers to the brands that we partner with to promote their products, services, discounts and deals.

1.5 “Members” relates to Users who has registered on the Website.

1.6 We reserve the right to change any of the Terms without prior notice, therefore it is advisable to check back regularly to ensure you remain in agreement.

2.1 Health Service Kicks and the Website www.healthservicekicks.com are owned and managed by Cash Kicks Ltd, company number 12404857.

3. Website Use

3.1 Our website allows Users to browse products, services, discounts and deals from our partner Retailers to help them save money while earning donations for their organisation. Users must register as Members in order to access any deals, including discount codes.

3.2 It is prohibited to copy or distribute any discounts, deals or voucher codes, including our marketing emails. This includes, but not limited to sharing via your organisation communications and social media.

3.3 By using our Website you warrant that you are 18 years old or older and have the authority to accept and be bound by the Terms.

3.4 Retailers provide us with content and discounts and we accept no liability for errors or omissions. This includes, but is not limited to, incorrect content, discounts that don’t work or have expired. Retailers have the right to change the detail, value or terms of any offer at any time without notice.

3.5 We’re constantly improving our website to bring you a first class experience and the Website will go through scheduled and sometime unscheduled maintenance. As such, we accept no liability for any issues or loss that may occur (directly or indirectly) as a result of the Website being unavailable. We may also add or remove website features without notice and accept no liability for any issues or loss that may occur, either directly or indirectly as a result. No warranty is provided by Health Service Kicks against any defects, worms, any electronic virus or problems that may occur as a result of using the Website. We accept no liability or responsibility for any failure, damage or loss caused by any virus or defect resulting from any email, attachment or document we send you.

3.6 It is the sole decision and responsibility of the member if they choose to transact and enter any agreement with our Retailers for their products or services. All transactions take place on our Retailers websites and we have no involvement or control over these operations or agreements. As a User, you accept that Health Service Kicks has no liability for any issues, refunds or cancellations in relation to these agreements or operations. In the event that the User has a problem or query with the product or service, the User should communicate directly with the Retailer to find a resolution.

3.7 In the event of an advertised discount not working, you may contact our customer service team who will be happy to assist. Our deals, discounts and donations are reliant on your visit being tracked from the Website to the Retailers website. It is important that you follow the instructions on the offer and click through from our website immediately prior to your purchase so you can claim your deal and generate a donation. We accept no liability for any purchases made that haven’t had any deal or discount applied, no donation generated or any loss or issues caused as a result. If Health Service Kicks are not tracked as the referer, we won’t be paid a commission and therefore no donation can be made and no claim can be made against us.

3.8 For the avoidance of doubt, Health Service Kicks will not be liable in contract, wrongful act, negligence or otherwise for any injury, loss or damage of any kind, whether direct or indirect, in whole or in part by use of the Website or its content.

 

4. Donations

4.1 As a business, we choose to donate a proportion of the commission we receive from referral sales to our members organisation. We believe in giving back to our communities and we hope these donations will help to make a difference.

4.2 For transparency, we provide a view of our donation (as a percentage or cash value) on each of our deals to give our Users an idea as to the value of donation they could generate from any purchase they make using that deal.

4.3 We reserve the right to alter the value of these donations or remove them at any time without notice or explanation.

4.4 Donations are dependent on successful tracking of the referral and sale along with verification and payment by the Retailer. In the event that any of these steps fail, no donations can be made and we accept no liability for loss, whatever the cause.

4.5 Verified sales may vary due to Retailers excluding costs such as delivery and VAT. Donations will be paid based on the final verification amount which will also exclude any returned items. Sales verification times vary greatly by Retailer which will affect donation times.

4.6 Donations will be paid to our members chosen Organisations by cheque sent via Royal Mail. These donations will be sent to the address of the  Organisations we have on record with the Payee stated as the Organisations name. Organisations may contact us to request a change to the Payee name if they have the permission and authority to do so whilst being able to provide proof.

4.7 Donation payments will be processed on a bi-monthly basis. A minimum of £50 must be accrued at the point of payment for a cheque to be generated and sent. If the minimum hasn’t been met, the amount will continue to accrue until it reaches the £50 minimum and will be paid on the following payment run.

4.8 Once a donation cheque has been successfully paid in, the Organisations have the responsibility for the money and how this is used. Health Service Kicks are not responsible in any way for how this money is distributed or utilised within the Organisations. Organisations hold no right, entitlement or ownership of any accrued donations and Health Service Kicks reserve the right to hold onto or cancel these donations at any time without notice, explanation or any liability whatsoever.

4.9 A User may delete their account at any time through the My Account section on the Website. Once done, we have no way of retrieving this User account or accessing any details that may have been stored with this, so we ask the User to think carefully before deleting their account. The User may register with a new account if they decide they would like to use our services again in the future.

 

5. Registration & Membership

5.1 You need to be a registered Member and accept all cookies to enjoy the full benefits of our Website and be able to use our deals while generating donations. Without this you may not be able to enjoy our discounts and help raise donations.

5.2 As part of registration, Members are opening an account with Health Service Kicks and the information used to provide you with our services. Full details can be found in our Privacy Policy.

5.3 It is the responsibility of the User to keep their account information up to date at all times and notify us of any changes immediately.

5.4 The User is responsible for the security of their username and password. These details should not be shared with anyone and no account should change hands under any circumstance. We accept no liability for any direct or indirect loss or damage whatsoever in the event of any security breach. If the User knows of any suspected security breach, they must notify Health Service Kicks immediately so we can place a block on the account.

5.5 If the User forgets their password, they can use the forgotten password link located within the login form. If problems persist, the User can contact our customer service team who will be happy to help.

5.6 Within the constraints of the law and at our discretion, we reserve the right to refuse acceptance of any registration, prohibit the use of the Website or delete an account if we believe the User isn’t complying with the Terms. Any unpaid and accrued donations by a User in this case will be declared null and void and reduced to £0.

 

6. Intellectual Property

6.1 Health Service Kicks can not be liable for any infringements or breaches of any trademark, copyright or other intellectual property rights.

6.2 We offer a non-commercial, non-exclusive and non-transferable licence so you may view and print the Website content for your own personal use only. This licence may be revoked at any time and without notice by Health Service Kicks. Use of the Website is by this licence only and Users agree that all trademarks, copyright and all other intellectual property rights, not limited to source code, graphics, text, design and software, are used by us as allowed by law or are licensed to or owned by Us.

6.3 You are prohibited from copying, reproducing, editing, or incorporating any of our content into any other materials without first gaining written permission from Health Service Kicks.

6.4 You may not alter or modify any registered or unregistered brand marks or logos owned by Us without first gaining written permission from Health Service Kicks.

 

7. General

7.1 We strongly advise our members to check our Retailers terms and conditions and privacy policies before sharing any information or transacting with them.

7.2 The Terms supersede any previous correspondence and they form the complete agreement between the User and Health Service Kicks.

7.3 Failure by either party to enforce or enact any conditions of the Terms will not constitute a waiver of the complete Terms. Each condition outside of any condition(s) failed to enforce will still remain in effect.

7.4 Users agree to allow Health Service Kicks 30 days to remedy any security breach.

7.5 Any queries or complaints can be addressed to our Customer Service team who will be happy to assist. We aim to respond these within 7 days.
